Reference received: 16 May 1995

Note: This reference was withdrawn by the Attorney General in February 1996 because it would have resulted in a duplication of work. A Special Working Party had been established to review aspects of the industrial relations legislation in New South Wales.

Terms of reference

To review legal aspects of the current operation of the Industrial Relations Act 1991 (NSW), and consider in particular:

  1. the system of registration of industrial organisations, including the constitutional validity of any such system; and

  2. the appropriate allocation of matters or proceedings between judicial and other members of an industrial tribunal or court constituted under a New South Wales law.
